County Council Approves Agreement on August 27, 2013

CLEVELAND –County Executive Ed FitzGerald, County Prosecutor Timothy J.McGinty, County Director of Law Majeed G. Makhlouf, and County Council President C. Ellen Connally reached an official agreement yesterday among their offices to govern the division of duties between the Cuyahoga County Prosecutor’s Office and Department of Law. County Council approved the official agreement at its August 27, 2013 meeting and authorized Council President C. Ellen Connally to execute it on behalf of the County Council.
 
Representatives of the Prosecutor’s Office, the Executive’s Office, County Council, and the Department of Law worked collaboratively to resolve these issues without litigation and with out an amendment to the County Charter. The result was a detailed 10-page agreement delineating the specific duties of each office to avoid any conflicts in the future.

“This compromise is a victory for Cuyahoga County's citizens,” said County Executive FitzGerald. “This detailed agreement was devised by the individuals who will live under it on a daily basis to foster cooperation and minimize conflict. The effort by those involved truly demonstrates what leaders can achieve when they concentrate on reaching practical, workable solutions."

County Prosecutor McGinty said, "On a day to day basis, the Cuyahoga County Prosecutor's Office has worked well with County Executive FitzGerald, the Law Department and the County Council to do the public's business. I have no doubt that that will continue to be true, especially now that we have an agreement in place that clarifies everyone's roles and responsibilities."

County Council President C. Ellen Connally said, “At some point, voters will be asked to reconcile conflicting Charter language on the Law Director and Prosecutor. But this agreement allows these important Charter officers time to implement a plan for the appropriate division of powers and duties. Council expects that the Prosecutor’s Office and the Law Department will work together productively under the agreement so as to ensure continued excellent representation of county and state interests.”
