2016 Tax Certificate Sale Negotiations Finalized

Cleveland - The Cuyahoga County Department of the Treasury has successfully completed negotiations for the 2016 tax certificate sale.  The $6 million portfolio, consisting of 619 parcels, has been purchased by Tax Ease Ohio, LLC.  Tax Ease Ohio, LLC has over 11 years of experience in the tax lien industry and currently operates in 10 states nationwide, servicing 35 Ohio counties.

Tax certificate sales are authorized by Ohio Revised Code sections 5721.30 to 5721.43 and allow the County Treasurer to sell the first lien on select properties to interested third party purchasers. The purchaser submits delinquent property tax payments to the County Treasury for distribution to local governments, with school districts receiving, generally, 60% of monies collected. 

 

"We were able to include increased consumer protections in the agreement that will enhance the process for the taxpayer" said Cuyahoga County Treasurer, Chris Murray.

Terms of the negotiated 2016 tax certificate sale include the following enhancements:

  • Live call center availability, 9am - 6pm EST at:  1-866-907-2626.
  • For property owners that were subject to the sale and enrolling in a payment plan, an itemized calculation of the tax lien balance will be included
  • Consent to judgment language or mandatory arbitration language will not be included in payment plans initiated prior to foreclosure action, allowing property owners to maintain legal rights in foreclosure proceedings.
  • Property owners will be allotted a 14 day “Cure Period” following the default notice of their payment plan.
  • Prior to filing a foreclosure action, the purchaser is required to contact a local government official to obtain relevant information regarding the certificate parcel and communicate their intentions with the municipality.

The Cuyahoga County Treasurer has established a tax delinquency response unit that will work directly with the purchaser to track the number of properties transferred or sold after foreclosure has taken place and alert affected municipalities.  The unit also works with the following nonprofit agencies to assists property owners in developing a delinquent tax payment agreement with the county to avoid the certificate lien:
